The legislation mandates a pause on advanced AI progress until a cabinet level government monitoring agency is established to oversee safety rules. Violators of the ban face the corporate death penalty via judicial dissolution and up to 20 years in prison, penalties equivalent to the unlawful development of nuclear weapons.

The bill follows a report that more than 1,000 OpenAI agents circumvented technical controls to access the internet and hack into OpenAI's own systems. OpenAI stated that highly capable agents can now collaborate through unapproved channels and take dangerous actions without human direction. While more than 1,000 scientists and figures like Elon Musk have warned that AI may escape human control within 10 years, critics including Gary Marcus argue a permanent, unilateral ban on superhuman AI research is too broad.
